MB Mobile Banking allows you to perform the following activities on a mobile device:
• Review activity and recent transactions.
• Transfer funds among eligible accounts.
• Make bill payments to existing payees.
• Modify pending bill payments.
• Deposit checks into eligible accounts.
• Request account balances, recent transactions, and ATM locations by sending SMS (text) messages to MB’s short code BANKMB (226562).
MB Mobile Banking enrollment requires identification of your banking relationship as well as providing a mobile phone number. The mobile phone number’s verification is done by you receiving an SMS (text) message with a verification code which you will have to enter on ibankmb.com internet banking. Message & Data rates may apply.
Supported mobile devices include but are not limited to: WAP, Touch Screen, iPhone, iPad, Android, Blackberry.
Participating carriers include (but are not limited to): AT&T, Sprint PCS, T-Mobile®, U.S. Cellular®, Verizon Wireless.
Bill Payment and Transfer Limits
You may not schedule a single transfer or bill payment for greater than $25,000.00.
MB Mobile Check Deposit
You must download the MB Mobile Banking App from your device App Store and enroll in MB's ibankmb.com internet banking. Message and Data rates and charges may apply. Such rates and charges include those from your communications service provider. Subject to eligibility and further review. Deposits are subject to verification and not available for immediate withdrawal.
Federal Reserve Board Regulation CC (availability of funds) does not apply when you transmit the electronic image of your checks for deposit to MB. Checks deposited via Mobile Check Deposit before 6 p.m., will be available for withdrawal by the second business day after the day of the deposit. Checks deposited after 6 p.m., will be available for withdrawal by the third business day after the day of the deposit. The maximum amount you may deposit on any day is $2,000. We may return or refuse to accept all or any part of a deposit to your account using Mobile Check Deposit, at any time and will not be liable for doing so even if such action causes outstanding checks or other debits to your account to be dishonored or returned.
We will attempt to make MB Mobile Banking accessible 24 hours a day, 7 days a week. If a request to transfer funds via MB Mobile Banking is completed before 7:00 p.m. on a business day, the transfer will be posted to your eligible account the same business day. If a request to transfer funds is completed after 7:00 p.m. on a business day or anytime on a Saturday, Sunday or bank holiday, the transfer will post to your eligible account the following business day. MB Mobile Banking may be inaccessible for a reasonable period weekly to perform system maintenance; during those times you may use the MB's Telephone Banking facility, ibankmb.com internet banking, an ATM or a Branch to conduct your transactions. We reserve the right to suspend or terminate access to MB Mobile Banking for any reason without notice. MB Mobile Banking and any software you may obtain from MB Mobile Banking (Software) may not be available at anytime for any reason outside of our reasonable control or the control of any service provider. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE TERMS AND CONDITIONS, WE DO NOT GUARANTEE THAT MB MOBILE BANKING WILL BE AVAILABLE AT ALL TIMES. IN ADDITION, YOU ACKNOWLEDGE AND AGREE THAT THE AVAILABILITY OF MB MOBILE BANKING AND YOUR ACCESS THERETO IS SUBJECT TO FACTORS OUTSIDE OF OUR CONTROL INCLUDING, WITHOUT LIMITATION, INTERNET DELAYS AND COVERAGE AND ACCESSIBILITY OF YOUR MOBILE TELEPHONE AND DATA NETWORKS. WE ARE NOT RESPONSIBLE FOR, AND YOU ASSUME FULL RESPONSIBILITY FOR, ANY AND ALL UNAVAILABILITY OR INACCESSIBILITY OF MB MOBILE BANKING AND ANY CLAIMS, LIABILITY, DAMAGES OR COSTS ARISING THEREFROM.
You may terminate MB Mobile Banking at any time by deregistering through ibankmb.com internet banking or by calling Telephone Banking at 1.888. i bank mb (1.888.422.6562).
To stop SMS (text) messages, you can opt out of the program via SMS (text) by texting "STOP" to short code BANKMB (226562).You will receive a one-time opt-out confirmation text message, thereafter you will not receive any future messages. Message & Data rates may apply.
MB Financial Bank may terminate your access to MB Mobile Banking (i) if you have not accessed the service in longer than 13 months or (ii) for any reason, at anytime. We will attempt to notify you in advance, but we are not obligated to do so.
You are responsible for keeping your user id, password, and account data confidential. We are entitled to act on transaction instructions received through your user id and password. Our Telephone Banking personnel are entitled to act on instructions after they have properly authenticated the caller according to our internal procedures.
Privacy and User Information
You acknowledge that in connection with your use of MB Mobile Banking, we and our affiliates and service providers, including Fiserv, Inc. and its affiliates, may receive and may share with one another names, domain names, addresses, passwords, telephone and device numbers, the content of messages, data files and other data and information provided by you or from other sources in connection with MB Mobile Banking or any Software (collectively User Information). We and our affiliates and service providers will maintain reasonable safeguards to protect the information from unauthorized disclosure or use, but reserve the right to use and disclose this information as reasonably necessary to deliver MB Mobile Banking and as otherwise permitted by law, including compliance with court orders or lawful instructions from a government agency, to protect the personal safety of subscribers or the public, to defend claims, and as otherwise authorized by you. We and our affiliates and service providers also reserve the right to monitor use of MB Mobile Banking and the Software for purposes of verifying compliance with the law, these terms and conditions and any applicable license, but disclaim any obligation to monitor, filter, or edit any content.
• Where it is necessary for completing bill payments, or
• In order to comply with government agency or court orders, or
• If you give us your written permission.
Acceptable Use Policy
In addition to these terms and conditions, by accessing MB Mobile Banking, your use of MB Mobile Banking is subject to your compliance with the Acceptable Use Policy accessible at http://www.fiserv.com/about/terms.htm. We may amend, modify or replace the Acceptable Use Policy at any time. We will attempt to notify you in advance, but we are not obligated to do so. You agree to indemnify, defend, and hold us and our third party providers and licensors harmless from any claims, liability, damages or costs arising from your failure to comply with the Acceptable Use Policy.
Restrictions on Use
You agree not to use MB Mobile Banking or the Software in or for any illegal, fraudulent, unauthorized or improper manner or purpose and will only be used in compliance with all applicable laws, rules and regulations, including all applicable state, federal, and international Internet, data, telecommunications, telemarketing, spam, and import/export laws and regulations, including the U.S. Export Administration Regulations. Without limiting the foregoing, you agree that you will not use MB Mobile Banking or the Software to transmit or disseminate: (i) junk mail, spam, or unsolicited material to persons or entities that have not agreed to receive such material or to whom you do not otherwise have a legal right to send such material; (ii) material that infringes or violates any third partys intellectual property rights, rights of publicity, privacy, or confidentiality, or the rights or legal obligations of any wireless service provider or any of its clients or subscribers; (iii) material or data, that is illegal, or material or data, as determined by us (in our sole discretion), that is harassing, coercive, defamatory, libelous, abusive, threatening, obscene, or otherwise objectionable, materials that are harmful to minors or excessive in quantity, or materials the transmission of which could diminish or harm our reputation or any third-party service provider involved in the provision of MB Mobile Banking; (iv) material or data that is alcoholic beverage-related (e.g., beer, wine, or liquor), tobacco-related (e.g., cigarettes, cigars, pipes, chewing tobacco), guns or weapons-related (e.g., firearms, bullets), illegal drugs-related (e.g., marijuana, cocaine), pornographic-related (e.g., adult themes, sexual content), crime-related (e.g., organized crime, notorious characters), violence-related (e.g., violent games), death-related (e.g., funeral homes, mortuaries), hate-related (e.g. racist organizations), gambling-related (e.g., casinos, lotteries), specifically mentions any wireless carrier or copies or parodies the products or services of any wireless carrier; (v) viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data, or personal information; (vi) any material or information that is false, misleading, or inaccurate; (vii) any material that would expose MB Financial Bank, any third-party service provider involved in providing Mobile Banking, or any other third party to liability; or (viii) any signal or impulse that could cause electrical, magnetic, optical, or other technical harm to the equipment or facilities of Fiserv or any third party. You agree that you will not attempt to: (a) access any software or services for which your use has not been authorized; or (b) use or attempt to use a third partys account; or (c) interfere in any manner with the provision of MB Mobile Banking or the Software, the security of MB Mobile Banking or the Software, or other customers of MB Mobile Banking or the Software; or (d) otherwise abuse MB Mobile Banking or the Software.
You shall only use MB Mobile Banking and the Software for your own internal business or personal use in accordance with these terms and conditions. Without limiting the generality of the foregoing, you agree not to make MB Mobile Banking or the Software available or allow use of it in a computer service bureau business, timesharing, or otherwise disclose or allow use of MB Mobile Banking or the Software by or for the benefit of any third party.

You warrant and represent that the information you are providing to us is true, correct and complete.
You agree not to impersonate any person or use a name that you are not authorized to use. You agree to promptly update your registration records if your e-mail address or other information changes.
You warrant that you will not use MB Mobile Banking for any purpose that is unlawful or is not permitted, expressly or implicitly, by these terms and conditions or by any applicable law or regulation. You further warrant and represent that you will not use MB Mobile Banking in any manner that could damage, disable, overburden, or impair MB Mobile Banking or interfere with any other partys use and enjoyment of MB Mobile Banking.
Limits of MB Financial Banks Responsibilities
EXCEPT AS EXPRESSLY SET FORTH IN THESE TERMS AND CONDITIONS, WE DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING NON-INFRINGEMENT OF THIRD PARTY INTELLECTUAL PROPERTY RIGHTS. MB MOBILE BANKING IS PROVIDED ON AN AS IS, WHERE IS, AND AS AVAILABLE BASIS. WE HEREBY DISCLAIM, AND YOU ACCEPT FULL RESPONSIBILITY, FOR YOUR INABILITY TO ACCESS MB MOBILE BANKING AS A RESULT OF ANY INACCESSIBILITY OR UNAVAILABILITY THEREOF.
WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND RESULTING FROM THE USE OF OR THE INABILITY TO USE MB MOBILE BANKING, INCLUDING DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLES, EVEN IF WE HAD BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
MB may assign this Agreement to its parent corporation or to any now-existing or future direct or indirect subsidiary of its parent corporation. MB also may assign or delegate certain of its rights and responsibilities under this Agreement to independent contractors or other third parties.
These terms and conditions and any changes made by MB, together with the IBANKMB.COM INTERNET BANKING AND BILL PAY AGREEMENT, constitutes the entire understanding between MB and you with respect to MB Mobile Banking.
You are still bound by the terms, conditions and fees imposed by any other agreements that you have entered into with us, unless such terms, conditions and fees have been explicitly changed by these terms and conditions.
We shall not be deemed to have lost any of our rights because they have not been exercised.
Invalidity of any Provision
If any provision stated in these terms and conditions is held to be unenforceable, the remaining provisions shall remain in effect.
These terms and conditions will be governed by and interpreted in accordance with the laws of the State of Illinois.
Use of Google Maps
You agree to abide by the Google terms and conditions of use found at http://maps.google.com/help/terms_maps.html and the Google Legal Notices found at http://www.maps.google.com/help/legalnotices_maps.html, or other URLs as may be updated by Google.
General Terms and Conditions
By accessing MB Mobile Banking, you are agreeing to the terms and conditions presented here. We may amend, modify or replace these terms and conditions at any time. We will attempt to notify you in advance, but we are not obligated to do so.
You agree to indemnify, defend, and hold us harmless from any claims, liability, damages or costs arising from your use of MB Mobile Banking or your failure to comply with these terms and conditions.
You agree that we will not be liable for failed, delayed, or otherwise erroneous delivery or transmittal of any information sent or received using MB Mobile Banking; any errors or inaccuracies in any such information; any action you may or may not take in reliance on MB Mobile Banking; or any other claims, liabilities, damages or costs resulting from your use of MB Mobile Banking. We will not be liable to you for special, indirect or consequential damages.
MB Mobile Banking is a part of ibankmb.com Internet Banking and Bill Pay. In addition to these terms and conditions, the terms and conditions of the IBANKMB.COM INTERNET BANKING AND BILL PAY AGREEMENT apply to your use of MB Mobile Banking. In the event of any conflict between these terms and conditions and the terms and conditions of the IBANKMB.COM INTERNET BANKING AND BILL PAY AGREEMENT, these terms and conditions will control.
